DUTIES AND RESPONSIBILITIES: - Ensure compliance with the Fair Debt Collection Practices Act (FDCPA) and applicable state laws governing debt collection and foreclosure.
- Prepare complaint packages, including civil cover sheets, summons, and exhibits, for filing with the court.
- Draft foreclosure pleadings, such as Notices of Sale, Notices of Hearing, Motions for Summary Judgment, and Final Judgments.
- Prepare cover letters for judges, including submissions of proposed orders, final judgments, and original documents.
- Conduct mortgage and satisfaction searches to verify lien status and property details.
- Draft Answers and Affirmative Defenses in response to foreclosure claims.
- Prepare motions for case management conferences, trial notices, and motions to reschedule sales or hearings.
- Schedule hearings and coordinate related logistics to ensure timely proceedings.
- Manage case files, and track deadlines.
REQUIRED SKILLS/ABILITIES: - Proficient with technology applications, including document management software, Microsoft Word, Excel, and Outlook.
- Experienced with State and Federal e-Filing systems and court filing procedures.
- Excellent written and verbal communication skills, with the ability to convey information clearly and professionally.
- Highly organized and detail-oriented, with the ability to manage multiple tasks and deadlines effectively.
EDUCATION AND EXPERIENCE: - Paralegal Certificate and/or Associates or degree preferred.
- Minimum of 2 years' experience with mortgage foreclosure.
